GENERAL TERMS & CONDITIONS

(Umrah, Hajj & Other Related Travel Services)

This Terms and Conditions Agreement (“Agreement”) is a legally binding contract between:

HISAR USA INC, a New Jersey corporation
Address: 970 Clifton Ave, Suite 202, Clifton, NJ 07013, USA
(“HISAR USA”, “we”, “us”, “our”)

and

The pilgrim/customer whose details appear on the Registration/Booking Form
(“Customer”, “you”, “your”, “I”).


1. PURPOSE AND SCOPE

1.1. HISAR USA is in the business of organizing, arranging, and facilitating Hajj, Umrah, and related travel services in the Kingdom of Saudi Arabia and other destinations (collectively, the “Services”), including but not limited to: flights, hotel accommodations, ground transportation, visa application assistance, guidance, religious tours (ziyārah), and related travel arrangements.

1.2. This Agreement governs all bookings, payments, and participation in any Umrah, Hajj or other travel package, whether booked:

  • via our website,

  • via phone, email, or in person,

  • through any authorized agent of HISAR USA.

1.3. By browsing our website, making an inquiry, submitting a registration form, paying any deposit or any amount toward any package, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement.


2. DEFINITIONS

For the purposes of this Agreement:

  • “Package(s)” means any Umrah, Hajj, ziyārah, or other travel program offered by HISAR USA.

  • “Group Package” means a package with fixed dates and group travel arrangements.

  • “Individual Package” means a customized or non-group package.

  • “Ramadan Package” means a package that includes travel during the month of Ramadan.

  • “Supplier(s)” means airlines, hotels, transportation providers, visa processing agents, and other third parties that provide services to you as part of your Package.

  • “Website” means any HISAR USA website, including but not limited to hisartour.com and its subpages.


3. ACCEPTANCE OF TERMS

3.1. This Agreement applies to all Umrah, Hajj, and related Packages provided by HISAR USA. Additional specific terms for particular Packages may apply and are incorporated by reference. In case of conflict, this Agreement prevails unless expressly stated otherwise in writing.

3.2. Acceptance of this Agreement occurs when you:

  • sign this Agreement, or

  • submit an online registration or booking, or

  • pay any amount toward a Package, or

  • otherwise confirm your booking with HISAR USA.

3.3. This Agreement, as amended from time to time, constitutes the entire agreement between you and HISAR USA and supersedes all prior oral or written agreements, understandings, representations or marketing materials, except where we explicitly state otherwise in writing.

3.4. All products, goods, tickets, vouchers, and travel arrangements remain the property of HISAR USA or its Suppliers until any and all invoices are paid in full and cleared into our account.

3.5. Every effort is made to ensure the accuracy of information on our website and marketing materials, but HISAR USA is not responsible for typographical errors or for changes due to unforeseen circumstances. In case of discrepancy, the final written invoice, booking confirmation, and this Agreement govern.


4. RESERVATIONS, DEPOSITS AND PAYMENTS

4.1 Deposits

4.1.1. Group Packages (Non-Ramadan):
A non-refundable deposit of USD 1,000 per passenger is required more than 30 days prior to departure to secure your reservation, reserve hotels and airline tickets, and to begin visa processing (where applicable).

4.1.2. Ramadan Packages:
A non-refundable deposit of USD 2,000 per passenger is required more than 30 days prior to departure.

4.1.3. Individual Packages:
Unless otherwise stated in writing, a non-refundable deposit of USD 500 per passenger is required to commence processing.

4.1.4. No Processing Without Deposit:
Your booking is not confirmed and HISAR USA will not start any processing (including hotels, tickets, or visa) until the full required deposit has been received and cleared in HISAR USA’s account.

4.2 Balance Payments

4.2.1. Full payment for Group and Ramadan Packages is due no later than 30 days prior to departure.

4.2.2. If the full balance is not received by the due date, HISAR USA reserves the right to:

  • cancel your booking, and

  • apply the cancellation and non-refund terms in Section 8.

4.2.3. For Individual Packages, flights may need to be paid in full at time of ticket issuance, as required by the airline. Failure to pay will result in non-issuance or cancellation of tickets.

4.2.4. All payments must be made in United States Dollars (USD), by the payment methods accepted by HISAR USA. Any bank fees, wire fees, or credit card surcharges (if applicable) are your responsibility.

4.3 Chargebacks

4.3.1. You agree not to initiate any credit card chargeback or reversal dispute for services that are subject to this Agreement.

4.3.2. Any attempt to charge back a legitimate, contractually due payment will be treated as a breach of this Agreement, and you will remain fully liable for:

  • the original amount, plus

  • any bank, processing, administrative, legal, and collection costs incurred.


5. PRICES, TAXES, SURCHARGES AND EXCHANGE RATES

5.1. All Package prices are based on current tariffs, airline fares, taxes, fuel surcharges, and exchange rates at the time of publication.

5.2. Prices for certain Group Packages may be based on a notional ticket cost (for example, USD 1,676.45 per passenger). Any increase in ticket cost, fuel surcharge, taxes, or government-imposed charges at the time of ticketing or prior to departure will be passed on to you and must be paid before tickets are issued.

5.3. All Package prices include applicable VAT / municipal taxes in Saudi Arabia (where stated), but may exclude additional local taxes, resort fees, city taxes, or similar charges, which remain your responsibility and may be payable directly to the hotel or authorities.

5.4. All prices are subject to availability and may change without prior notice before full payment is received. Once you have paid in full and received written confirmation, the price is generally fixed, except for:

  • new or increased government taxes or charges,

  • airline fuel surcharges,

  • major currency fluctuations, or

  • clear system or human billing error.

5.5. In case of billing error, HISAR USA reserves the right to re-invoice you with the correct amount. If you do not wish to proceed at the corrected price, cancellation terms in Section 8 will apply.


6. CUSTOMER RESPONSIBILITIES

You agree and represent that:

6.1. All information you provide (names, dates of birth, passport details, contact details, etc.) is true, accurate, complete, and up to date.

6.2. You will review all documents received from HISAR USA (invoices, confirmations, tickets, visas, hotel vouchers) and immediately notify us in writing of any errors or discrepancies before departure.

6.3. You are solely responsible for:

  • obtaining and holding valid passports, visas, and required documentation;

  • complying with all immigration, health, customs, and security requirements of each country;

  • respecting the laws, regulations, and cultural/religious norms in Saudi Arabia and all transit countries;

  • maintaining proper behavior during travel and stay.

6.4. You will follow the instructions of HISAR USA staff, group leaders, and local guides, especially concerning safety, group meeting times, hotel check-in/out, transportation, and performance of religious rituals.

6.5. You are responsible for any fines, penalties, costs, or damages imposed on you or HISAR USA as a result of:

  • overstay of your visa,

  • violation of Saudi or U.S. laws,

  • carrying prohibited items,

  • misrepresentation or false declarations (e.g., at immigration or for public benefits).


7. TRAVEL DOCUMENTS, PASSPORTS AND VISAS

7.1. HISAR USA may assist with Umrah or Hajj visa applications, but the final decision rests solely with the Saudi authorities. HISAR USA does not guarantee visa approval under any circumstances.

7.2. You are solely responsible for ensuring that:

  • your passport is valid for at least six (6) months beyond your date of return, and has sufficient blank pages;

  • you meet all eligibility requirements for the visa;

  • all documentation (marriage certificates, birth certificates, residency permits, etc.) is valid, accurate, and provided within the timelines requested.

7.3. HISAR USA is not liable for:

  • denial, delay, revocation, or incorrect issuance of visas by any embassy or consulate;

  • any fines, penalties, or losses arising from missing, invalid, or incomplete documentation;

  • any loss or delay of passports or documents once they are in the custody of couriers, embassies, consulates, or other third parties.

7.4. If your trip is cancelled or disrupted because you fail to obtain or maintain required documents or comply with visa rules, HISAR USA will not be responsible for any costs or refunds, and cancellation terms in Section 8 apply.

7.5. You understand that Umrah/Hajj visas are typically valid only for travel to Jeddah, Makkah, and Madinah. Travel to other cities may violate visa conditions and expose you to penalties. You agree to bear all consequences and reimburse HISAR USA for any charges imposed on us due to your actions.

7.6. Overstaying Umrah/Hajj visas is a serious violation. If HISAR USA is charged or held liable for any overstay penalties, fines, or associated costs, you agree to fully indemnify and reimburse HISAR USA, which may amount to USD 10,000 or more per person, plus legal and administrative fees.


8. CHANGES, CANCELLATIONS AND REFUNDS BY CUSTOMER

8.1. All deposits are strictly non-refundable, including for medical or health reasons, change of mind, or any other cause.

8.2. Cancellations must be made in writing (email or letter) and are effective only when received by HISAR USA.

8.3. Unless otherwise specified for a specific Package:

  • More than 30 days prior to departure:

    • You forfeit 100% of all deposits paid.

    • Any additional payments may be partially refundable subject to airline and supplier rules, less our administrative fees. Many airline tickets and services are strictly non-refundable.

  • 30 days or less prior to departure:

    • No refund of the full package price (Nil Refund).

    • You agree that HISAR USA and its Suppliers will have incurred non-recoverable costs and your seat, hotel space, and related services will likely be unsellable at such short notice.

8.4. No refunds will be issued for:

  • no-shows,

  • late arrivals,

  • early departures,

  • unused services, meals, nights, or tours,

  • interrupted travel due to your decision or behavior.

8.5. Where refunds are due from Suppliers (e.g., airlines) for unused or cancelled services, HISAR USA will forward such refunds to you only after they are actually received from the relevant Supplier, less any administrative fees. Processing times are determined by Suppliers and may take several weeks or months.


9. CHANGES AND CANCELLATIONS BY HISAR USA OR SUPPLIERS

9.1. HISAR USA reserves the right, at any time before or during your trip, to:

  • substitute hotels with similar or reasonably equivalent standard accommodations;

  • change room configurations, hotel blocks, or room numbers;

  • modify itineraries, routes, or dates due to operational or safety reasons;

  • rebook flights or ground transportation as needed.

9.2. Such changes may occur due to, but not limited to:

  • airline schedule changes or cancellations;

  • overbooking or unavailability of hotel rooms;

  • local regulations or crowd control measures (especially during Hajj/Ramadan);

  • weather, natural disasters, health emergencies, or security concerns.

9.3. If we are forced to cancel a Package before departure for reasons within our control, we may:

  • offer an alternative Package of similar value, or

  • refund amounts paid to us, less non-recoverable third-party costs already incurred.

9.4. If a trip is cancelled, modified, or disrupted due to force majeure or events outside our reasonable control (see Section 17.4), we will have no obligation to provide a full refund. Where possible, we will assist you in applying for any refunds or credits from Suppliers, but we do not guarantee any outcome.


10. HOTELS, ROOMING AND ITINERARY

10.1. Hotel star ratings in Saudi Arabia and other countries may differ from standards in the U.S. You acknowledge that star ratings are based on local classification, and HISAR USA is not responsible for differences in expectations.

10.2. Due to high demand and congestion during Hajj and Ramadan, hotel locations, views, elevator waiting times, and dining crowding are beyond the control of HISAR USA.

10.3. If you request a Quad, Triple, or Double occupancy room:

  • You must have the required number of occupants listed on your registration, or

  • You authorize HISAR USA to attempt to find suitable roommates (same gender) where possible,

  • If we cannot find suitable roommates, you agree to pay the price difference for the applicable room category (e.g., upgrade to triple, double, or single).

10.4. Standard hotel check-in is from approximately 4:00 PM, and check-out is by approximately 12:00 PM (noon). Early check-in or late check-out is not guaranteed and may incur additional costs payable by you.

10.5. Itineraries provided are approximate and subject to change. Certain visits or activities may be cancelled or replaced due to time, crowd management, or safety considerations.


11. LUGGAGE AND PERSONAL PROPERTY

11.1. HISAR USA is not responsible for loss, theft, or damage to luggage, money, passports, medication, electronics, or any personal property at any time.

11.2. You are strongly advised to:

  • keep valuables with you in a secure manner,

  • use hotel safes where available,

  • clearly label all baggage,

  • purchase comprehensive travel insurance (see Section 12).

11.3. Airline baggage policies, allowances, and fees are determined by the airline and may change without notice. You must comply with airline rules and are solely responsible for any excess baggage charges.


12. INSURANCE

12.1. Travel insurance is strongly recommended for all Customers. It is your responsibility to purchase appropriate insurance that covers, at minimum:

  • trip cancellation and interruption,

  • medical and emergency evacuation,

  • loss or delay of luggage,

  • personal accident and liability.

12.2. HISAR USA does not sell or provide insurance advice. We are not responsible for any losses that could have been covered (in whole or in part) by insurance.


13. INFANTS, CHILDREN AND FAMILY TRAVEL

13.1. Unless otherwise stated:

  • Children 8 years and older are considered adults and pay full Package price.

  • Children between 2 and under 8 years may receive an approximate 25% reduction from the advertised Package price, subject to hotel and airline policies.

  • Children under 2 years will be charged a flat fee (e.g., USD 1,000) to cover visa, processing, and infant flight costs, as per airline and hotel rules.

13.2. Minors traveling must comply with Saudi and U.S. rules on guardianship and mahram requirements. You are responsible for providing required documentation (birth certificates, consent letters, etc.).


14. APPLICATION PROCESSING AND VISA HANDLING

14.1. HISAR USA will check your documents for completeness and forward them to the appropriate Saudi Embassy, Consulate, or authorized visa center (e.g., in Washington, D.C. or New York), as applicable.

14.2. Processing times are determined by the authorities and can change without notice. HISAR USA is not responsible for delays in visa processing.

14.3. Because HISAR USA manages a large volume of pilgrims, you agree to limit communication during peak processing times to urgent matters only, and to respond promptly to any request for additional documents or information.


15. FLIGHT TICKETS – CONDITIONS & AIRLINE RESPONSIBILITY

15.1. For many Group and Holy Land Packages, airfares are based on agreed group fares. Any increase in base fare, fuel surcharge, taxes, or fees at the time of ticket issuance is your responsibility.

15.2. Name corrections, date changes, or ticket reissues after ticketing typically incur substantial fees (e.g., USD 550 or more per change) plus any fare difference, as per airline rules. These costs are your responsibility.

15.3. Some tickets are non-refundable and/or non-changeable once issued. Airline rules prevail in all cases.

15.4. HISAR USA acts only as a booking agent for airlines and does not operate or control flights. The airline is solely responsible for:

  • schedule changes, delays, and cancellations,

  • lost or damaged baggage,

  • denied boarding,

  • in-flight services, safety, and conditions.

15.5. In the event of delays, cancellations, or overbooking, airline policies and procedures apply. HISAR USA will assist where reasonably possible but is not liable for compensation beyond what the airline provides.


16. BEHAVIOR, REMOVAL FROM TOUR, AND REFUSAL OF SERVICE

16.1. You are expected to maintain respectful and appropriate behavior toward other pilgrims, HISAR USA staff, hotel staff, guides, and local residents.

16.2. HISAR USA reserves the right to refuse or cancel bookings or remove any participant from a trip, without refund, if in our sole discretion that person:

  • engages in threatening, abusive, or violent behavior,

  • is disruptive, intoxicated, or endangers themselves or others,

  • repeatedly disregards instructions of group leaders,

  • violates local laws or hotel rules.

16.3. In such cases, you will bear all additional costs for alternative arrangements, return travel, or damages caused, and no refund will be provided.

16.4. HISAR USA also reserves the right to refuse bookings, or cancel confirmed bookings (with appropriate refund where required), for reasons including but not limited to:

  • suspected fraud or misuse,

  • legal or sanction restrictions,

  • breach of this Agreement,

  • abusive or threatening communications.


17. LIMITATION OF LIABILITY AND FORCE MAJEURE

17.1. HISAR USA acts as agent for various Suppliers (airlines, hotels, transport companies, etc.). We exercise reasonable care in selecting Suppliers but do not control their operations and are not responsible for their acts, omissions, or negligence.

17.2. To the maximum extent permitted by law, HISAR USA and its officers, directors, employees, agents, and affiliates shall not be liable for:

  • any indirect, consequential, incidental, special, or punitive damages,

  • loss of enjoyment, emotional distress, inconvenience, or disappointment,

  • loss or damage to property,

  • personal injury, illness, or death, except where caused solely by our gross negligence or willful misconduct.

17.3. In all cases, the total aggregate liability of HISAR USA, whether in contract, tort, or otherwise, shall not exceed the total amount actually paid by you to HISAR USA for the affected Package.

17.4. HISAR USA shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control (“Force Majeure”), including but not limited to:

  • war, terrorism, civil unrest, or political instability,

  • epidemics, pandemics, public health emergencies, quarantines,

  • natural disasters, extreme weather, or environmental conditions,

  • government actions, visa/entry restrictions, or border closures,

  • labor disputes, strikes, or industrial actions,

  • major technical failures, power outages, or communication breakdowns.

17.5. In the event of Force Majeure, HISAR USA may:

  • modify or cancel the trip,

  • substitute services,

  • assist you in obtaining credits or refunds from Suppliers where possible,
    without incurring any additional liability.


18. INDEMNIFICATION

18.1. You agree to defend, indemnify, and hold harmless HISAR USA, its officers, directors, employees, agents, and affiliates from and against any and all claims, demands, actions, damages, losses, fines, penalties, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • your breach of this Agreement,

  • your violation of any law or regulation,

  • your misrepresentation or provision of inaccurate or incomplete information,

  • your conduct during travel, including any damage you cause to property or injury to persons,

  • any claims brought by other participants you booked on behalf of.


19. COMPLAINTS AND CLAIMS

19.1. If you experience any issue during your trip, you must promptly notify HISAR USA or our local representative at the time so that we have a reasonable opportunity to address it.

19.2. Any complaint or claim against HISAR USA must be submitted in writing within 30 days of your return date. Claims received after this period may be rejected as untimely.

19.3. No promise, statement, or representation by any agent, supplier, or third party will be binding on HISAR USA unless confirmed in writing by an authorized officer of HISAR USA.


20. DATA PROTECTION AND COMMUNICATIONS

20.1. You consent to HISAR USA collecting, storing, and using your personal data (and that of any passengers you book on behalf of) for the purposes of:

  • processing bookings and payments,

  • arranging travel, visas, and accommodations,

  • complying with legal and regulatory requirements,

  • communicating with you regarding your booking, updates, and important notices.

20.2. You consent to HISAR USA sharing your information with necessary Suppliers (airlines, hotels, visa agents, etc.) solely for the purpose of delivering the Services.

20.3. You agree that HISAR USA may contact you by phone, email, SMS, messaging apps, or other channels regarding your booking and, where permitted by law, with relevant information and promotional offers. You may opt out of marketing communications at any time by following the provided instructions.


21. GOVERNING LAW AND DISPUTE RESOLUTION

21.1. This Agreement is governed by and construed in accordance with the laws of the State of New Jersey, and applicable U.S. federal law.

21.2. Negotiation:
In the event of any dispute, the parties shall first attempt in good faith to resolve the matter through informal negotiation.

21.3. Arbitration (if you choose to keep this clause):
Except where prohibited by law, any unresolved dispute arising out of or in connection with this Agreement shall be finally resolved by binding arbitration administered in New Jersey under the rules of a recognized arbitration institution. The arbitration shall be conducted in English. The decision of the arbitrator shall be final and binding on both parties.

21.4. Jurisdiction:
To the extent arbitration is not applicable or enforceable, the parties agree to submit to the exclusive jurisdiction of the state and federal courts located in New Jersey, and you waive any objection based on inconvenient forum.

21.5. Class Action Waiver:
To the maximum extent permitted by law, you agree that any claim against HISAR USA shall be brought on an individual basis only, and not as a plaintiff or class member in any purported class or representative action.


22. MISCELLANEOUS

22.1. If any provision of this Agreement is held to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

22.2. HISAR USA may assign or transfer its rights and obligations under this Agreement to another entity in connection with a merger, reorganization, sale of assets, or similar transaction. You may not assign your rights or obligations without our prior written consent.

22.3. Any failure or delay by HISAR USA to enforce any provision of this Agreement shall not constitute a waiver of such provision or of any other rights.

22.4. This Agreement may be updated by HISAR USA from time to time. The version in force at the time of your booking, as provided to you or published on our website, shall apply to your Package.


23. CUSTOMER ACKNOWLEDGMENT

By signing below or by submitting an online registration and/or making payment toward any Package, you confirm that:

  • You have read, understood, and agree to be bound by this Terms & Conditions Agreement.

  • You are 18 years or older and have the legal capacity to enter into this Agreement.

  • Where you book on behalf of other participants, you have the authority to do so and you will ensure they are aware of and agree to these Terms & Conditions.
