These Terms explain the conditions that apply to any inquiry, registration, booking, payment, or participation in an Umrah, Hajj, ziyārah, or related travel program offered, arranged, or supported by Hisar Tour.
Section 3 explains an important distinction. For Umrah and cultural tours, Hisar Tour is the tour operator. For Hajj, Hisar Tour is a guidance, preparation, and group-support partner — your Hajj package is booked and paid for on the Saudi government’s official Nusuk platform. Please read Sections 3 and 9 before registering for Hajj.
Section 23 contains a binding arbitration agreement and a class action waiver that affect your legal rights, including your right to bring a lawsuit in court and your right to a trial by jury. You may opt out of arbitration within 30 days. Please read Section 23 carefully.
In these Terms, “Hisar Tour,” “HISAR USA,” “we,” “us,” and “our” refer to HISAR USA INC. “You,” “your,” “customer,” “traveler,” and “pilgrim” refer to the person registering, booking, paying, or traveling.
Hisar Tour is the travel services brand of HISAR USA INC., a corporation organized under the laws of the State of New Jersey on October 17, 2017 (New Jersey entity identification number 0450208903), with its principal business address at 970 Clifton Avenue, Suite 202, Clifton, New Jersey 07013.
HISAR USA INC. is a wholly owned subsidiary of United American Muslim Association of N.Y., Inc., a religious non-profit organization established in the State of New York, which holds one hundred percent of the shares of the Corporation.
“Hisar Tour” is a registered alternate name of HISAR USA INC. in the State of New Jersey.
Hisar Tour organizes group Umrah programs, ziyārah and cultural tours, and provides guidance, preparation, and group-support services for pilgrims performing Hajj through the Saudi government’s official Nusuk Hajj platform.
2.1 Scope. These General Terms & Conditions (“Terms”) govern the travel and travel-related services offered, arranged, sold, promoted, coordinated, or supported by Hisar Tour, including group Umrah programs, ziyārah and cultural tours, individual and customized travel arrangements, flights, hotels, ground transportation, visa-processing assistance, educational seminars and webinars, group religious guidance, and Hajj guidance and group-support services as described in Sections 3 and 9 (collectively, the “Services”). A specific travel program sold by Hisar Tour is referred to as a “Package.”
2.2 Formation of contract. A travel contract is formed when we accept your booking in writing, issue a booking confirmation, or accept a payment toward a Package, whichever occurs first. Submitting an inquiry, creating a website account, completing a pre-registration form, or viewing our website does not by itself create a confirmed booking or guarantee availability or price.
2.3 Acceptance. You accept these Terms when you check the acceptance box during registration or booking, sign a registration form, submit a booking, or make any payment toward a Package, whichever occurs first. If you book on behalf of other travelers, you represent that you are authorized to accept these Terms on their behalf, and you agree to provide them with a copy.
2.4 Order of precedence. Package-specific terms, payment schedules, cancellation notices, invoices, booking confirmations, supplier conditions, Saudi government and Nusuk requirements, and travel documents are incorporated into these Terms. If documents conflict, the following order applies:
2.5 No informal variation. No oral statement, social-media post, advertisement, webinar remark, agent statement, or informal message changes these Terms unless confirmed in writing by an officer or other representative of HISAR USA INC. expressly authorized by its Board of Directors to bind the Corporation.
2.6 Version applicable to your booking. The version of these Terms in force and accepted by you at the time of booking applies to that Package, unless a later change is required by law or by a government or official platform rule. Each version is assigned a version number and archived. On request, we will provide you with a copy of the version you accepted.
3.1 Umrah, ziyārah and cultural tours. For these programs, Hisar Tour acts as the tour operator and organizer. Hisar Tour assembles the Package, contracts with airlines, hotels, transport operators, visa processors, and other suppliers, receives your payment, and is your counterparty for the Package. The suppliers who deliver individual services remain independent contractors (Section 10).
3.2 Hajj. For Hajj, Hisar Tour acts as a guidance, preparation, marketing, and group-support partner. Hisar Tour is not the Saudi Hajj operator, is not the Nusuk platform, and does not supply your Hajj package. Your travel contract for the Hajj package is with the Saudi-licensed service provider you select inside Nusuk, on the terms of that platform. Section 9 governs Hajj in full and prevails over any conflicting provision of these Terms.
3.3 Services purchased separately from Hisar Tour in connection with Hajj. Hisar Tour does not collect the Nusuk Hajj package price (Section 9.2). The only amount Hisar Tour may invoice you in connection with Hajj is an optional hady (sacrificial offering) fee, where you choose to arrange your hady through Hisar Tour rather than through Nusuk. This is optional, is offered only to pilgrims who request it, and is invoiced separately and clearly identified. It is a contract with Hisar Tour and is governed by these Terms, including Sections 5, 14 and 18. It is not part of, and does not alter, the Nusuk package contract.
3.4 How Hisar Tour is compensated for Hajj services. Hisar Tour receives a commission from the Saudi service provider in respect of pilgrims it supports, payable after the Hajj season. Hisar Tour does not charge you a guidance, registration, or group-support fee for Hajj, and the commission does not increase the price you pay on Nusuk. We disclose this so that you understand the basis on which our Hajj guidance services are provided.
3.5 Geographic scope. These Terms apply to services provided by HISAR USA INC. to travelers in the United States and Canada. Pilgrims resident in other countries are served by separate Hisar organizations under separate terms, and this agreement does not apply to them.
4.1 Prices, flights, hotels, rooms, visas, and other travel components are subject to availability until confirmed in writing. A quotation, price estimate, cost estimator result, or advertised “from” price is not a reservation, ticket, visa, or guarantee of price.
4.2 We may correct an obvious pricing, publishing, system, or human error before final confirmation. If a correction materially changes your booking and you choose not to proceed, we will return amounts paid that have not been committed to non-recoverable supplier charges or processing costs, subject to applicable law.
4.3 Your reservation is not final until the required deposit or full payment, accurate passenger information, and any required documents have been received and cleared. We may decline or cancel an incomplete booking where information, payment, documentation, compliance screening, or supplier confirmation is missing or unsatisfactory.
Unless the applicable package invoice states otherwise, a deposit of thirty percent (30%) of the total Package price per passenger is required to reserve your place and to begin supplier, visa, and documentation processing.
By way of example, on a Package priced at USD 3,250 per passenger the deposit is USD 975. The exact deposit amount for your Package is shown before you confirm your booking and on your invoice.
Where a card processing fee applies, it is calculated on the amount payable and shown separately before you confirm payment (Section 5.5).
The deposit secures your place in the group and funds work and commitments that begin immediately on receipt, including administrative and file-opening work, supplier and hotel block deposits, airline seat holds and deposits, visa and documentation processing, and group planning. The deposit is non-refundable once processing begins, regardless of when you cancel. The deposit is set as a proportion of the Package price because the commitments Hisar Tour makes on your behalf scale with the value and category of the Package. It represents a reasonable pre-estimate of those costs and commitments at the point of booking, and is not a penalty.
A different package-specific payment schedule controls where expressly stated in writing on your invoice.
Unless your final invoice states a different date, full payment for group and Ramadan Packages is due no later than 30 days before departure. Airline tickets, upgrades, private arrangements, and certain supplier services may require earlier or immediate payment. All payments must be made in USD using an accepted payment method. Bank, wire, card, installment, and currency-conversion charges are the customer’s responsibility unless we agree otherwise in writing.
If payment is late, we may cancel the booking, release reserved inventory, withhold ticketing or documents, and apply the cancellation terms in Section 14. A booking may be reinstated only if space remains available and all additional supplier charges are paid.
If you believe a charge is incorrect, please contact us promptly so that we can investigate and attempt to resolve the matter. Nothing in these Terms limits any non-waivable right you may have under applicable law to dispute an unauthorized transaction or billing error.
For disputes concerning a booked Package, you agree to first give Hisar Tour a reasonable opportunity to review the issue and provide supporting documents. If a payment dispute or chargeback is resolved in our favor, or results from a customer’s breach of these Terms, you remain responsible for the valid unpaid balance and for reasonable, documented costs incurred in responding to the dispute or collecting the amount, to the extent permitted by law.
Where you pay by credit card, a card processing fee may be added to your payment. Any such fee is shown separately before you confirm payment and is listed as a separate line on your receipt. The fee is not charged on payments made by bank transfer, check, or debit card. If your booking is refunded under these Terms, the card processing fee is refunded only to the extent our payment processor returns it to us.
6.1 Package prices are based on supplier rates, airfare, taxes, fuel charges, currency conditions, occupancy, availability, and government rules known when the Package is priced.
6.2 Before ticketing and final written confirmation, prices may change due to supplier increases, changes in taxes or fees, currency movements, airline fare changes, or government charges.
6.3 After full payment and final written confirmation, we will not increase the price except where an increase is caused by government taxes or fees, airline fuel surcharges, material currency changes, supplier-imposed charges outside our reasonable control, or an obvious billing or system error. We will give you written notice of any such increase.
6.4 Your right to cancel on a material increase. If a price increase applied after full payment and final written confirmation exceeds eight percent (8%) of the total Package price, you may cancel the Package by written notice within seven (7) days of our notice, and we will refund all amounts you have paid to Hisar Tour less charges already incurred and not recoverable from suppliers, which we will document to you.
6.5 Exclusions. Unless expressly included on your invoice, Package prices may exclude passport fees, vaccination and health requirements, optional upgrades, room service, hotel incidentals, local tourism or city taxes, baggage fees, Qurbani, personal expenses, gratuities, and any service not expressly listed as included.
7.1 You are responsible for providing accurate, complete, and current information for yourself and anyone you book for, including names exactly as shown on passports, dates of birth, contact details, travel documents, rooming choices, and any information required for travel or visa processing.
7.2 You must review your confirmation, invoice, tickets, visa, hotel vouchers, and other documents immediately upon receipt and notify us in writing of any error. You are responsible for losses caused by incorrect information, late review, delayed responses, or failure to provide requested documents by stated deadlines.
7.3 You must comply with applicable laws, customs, health requirements, immigration rules, airline conditions, hotel rules, Saudi regulations, group schedules, and the reasonable directions of Hisar Tour staff, group leaders, imams, murshids, local guides, and suppliers. You are responsible for fines, penalties, losses, or costs caused by your conduct, false declaration, prohibited items, visa overstay, non-compliance, or damage to property.
7.4 Sanctions and screening. You represent that you are not identified on any United States restricted-party, sanctions, or denied-persons list, and that your participation does not violate applicable export control or sanctions law. We may screen bookings and decline or cancel where screening is unsatisfactory.
8.1 Hisar Tour may assist with document review and visa-related processing, but visa issuance, entry permission, Nusuk access, Hajj eligibility, airline boarding, and admission to any country are controlled solely by the relevant authorities and suppliers. We do not guarantee visa approval, entry, Hajj permits, Rawdah appointments, airline boarding, or access to any site or service.
8.2 You are responsible for maintaining a passport valid for the required period — typically at least six months after your return date — and for providing all requested documentation on time. You are responsible for confirming your own eligibility for travel, visa, vaccination, health, immigration, transit, and residency requirements.
8.3 If your journey is canceled, delayed, denied, or disrupted because of missing, inaccurate, late, invalid, or incomplete documents; a visa or entry refusal; a government decision; or your failure to comply with applicable rules, the cancellation and supplier rules apply and Hisar Tour is not responsible for the resulting loss, penalties, or missed travel services.
8.4 Umrah and Hajj visa holders must comply with Saudi law and the conditions of their visas. Any overstay, unauthorized travel, or violation may lead to serious penalties. You agree to reimburse Hisar Tour for reasonable, documented fines, charges, losses, or costs imposed on us as a result of your own breach or misconduct.
For Hajj, Hisar Tour acts as a guidance, preparation, marketing, and group-support partner. Hisar Tour is not the Saudi Hajj operator, is not the Nusuk platform, and is not the party that supplies your Hajj package.
Hajj for pilgrims traveling from the United States and Canada is booked through the Saudi government’s official Nusuk Hajj platform (hajj.nusuk.sa), operated under the authority of the Saudi Ministry of Hajj and Umrah. Your Hajj package is supplied by the Saudi-licensed service provider you select inside Nusuk. Your travel contract for the Hajj package is with that provider and the Nusuk platform, not with Hisar Tour.
Payment for a Nusuk Hajj package is made by you, directly inside the Nusuk platform, through your own Nusuk account and eWallet. Hisar Tour does not receive, hold, process, or refund the Nusuk package price.
Security notice. Hisar Tour will never ask you for your Nusuk password, one-time codes, or eWallet credentials, and will never ask you to send the Hajj package price to Hisar Tour. If you receive such a request purporting to come from Hisar Tour, do not act on it and contact us immediately at +1 (201) 201-8992.
The only amount Hisar Tour may invoice you in connection with Hajj is the optional hady fee described in Section 3.3, where you choose to arrange your hady through Hisar Tour. It will be invoiced in writing and clearly identified. Only that separately invoiced amount is governed by Sections 5, 14 and 18. Hisar Tour receives a commission from the Saudi service provider as described in Section 3.4.
Package names, hotels, Mina camp assignments, durations, inclusions, and prices shown on Hisar Tour’s website, brochures, webinars, cost estimators, or social channels are indicative information about packages published or expected to be published on Nusuk. They are descriptive information, not an offer by Hisar Tour, and they do not create a contract with Hisar Tour.
Final package content, availability, allocation, and price are set and confirmed inside the Nusuk platform at the time of booking, and may differ from information shown by Hisar Tour. Cost estimators and price ranges are planning tools only and are not quotations.
The following are determined solely by the Saudi government, the Nusuk platform, and your selected Saudi service provider, and are outside Hisar Tour’s control:
Saudi regulations, health requirements, mahram rules, vaccination requirements, and platform procedures may change before or during the season, including after your booking is confirmed.
Cancellation, amendment, and refund of a Nusuk Hajj package are governed exclusively by the terms of the Nusuk platform and your selected Saudi service provider. Section 14 of these Terms does not apply to the Nusuk package price.
Hisar Tour cannot cancel, amend, or refund a Nusuk booking on your behalf beyond providing reasonable assistance and guidance, and cannot refund funds it has not received.
Optional hady fee. Where you have paid Hisar Tour an optional hady fee, that fee is refundable in full if you notify us in writing before the hady has been arranged on your behalf. Once the hady has been arranged, the fee is non-refundable. If you do not travel or your Hajj booking does not proceed, and the hady has not yet been arranged, the fee is refunded in full.
Where you have registered with Hisar Tour for a Hajj season and Hisar Tour has confirmed your participation in a Hisar Tour group in writing, Hisar Tour will use reasonable professional care to provide:
These are services of guidance, education, and coordination. They are not a guarantee of any booking, permit, allocation, service standard, facility, appointment, or outcome delivered by Nusuk, the Saudi service provider, or any government authority.
Subject to Section 18 and to the extent permitted by law, Hisar Tour is not responsible for the acts, omissions, delays, changes, service standards, cancellations, or refund decisions of the Nusuk platform, the Saudi Ministry of Hajj and Umrah, your selected Saudi service provider, camp operators, hotels, transport operators, or any other third party involved in the Hajj program.
Hisar Tour is likewise not responsible for a booking you make or fail to make on Nusuk, for a package that sells out, for information you enter into your own Nusuk account, for a payment you make inside Nusuk, or for loss arising from your failure to complete verification, funding, or booking steps within the timeframes announced by Nusuk.
Hisar Tour is part of an international group. The commercial agreements with the Saudi-licensed Hajj service provider are entered into by the group’s head office in Istanbul, and not by HISAR USA INC. HISAR USA INC.’s role in relation to Hajj is to act as a marketing partner before booking, and as an educational and guidance partner before and during the journey, for pilgrims in the United States and Canada.
References by Hisar Tour to awards, rankings, partnerships, or affiliations describe the record and standing of the named partner organization or of the wider Hisar group. They are not a representation that HISAR USA INC. is a Saudi-licensed Hajj operator, and they do not guarantee any particular service standard for your journey.
Where any other provision of these Terms conflicts with this Section 9 in relation to a Nusuk Hajj booking, this Section 9 prevails, subject only to mandatory law and government or platform requirements under Section 2.4(1).
10.1 Airlines, hotels, transportation companies, visa processors, insurance providers, camp operators, and other suppliers are independent contractors. Hisar Tour arranges or facilitates services but does not own or control their operations unless expressly stated otherwise.
10.2 Airline schedules, aircraft, routes, baggage limits, meals, seating, delays, cancellations, re-routing, denied boarding, and ticket rules are controlled by the airline. Even a flight promoted as direct or non-stop may be changed by the airline. We will reasonably assist with supplier communications where practical, but compensation or remedy is governed by the applicable supplier’s rules and by applicable law.
10.3 You must arrive at the airport, meeting point, hotel lobby, bus, train, and group gathering points at the announced time. No refund is due for a missed departure, late arrival, no-show, or missed transfer caused by you.
11.1 Hotels, room types, views, bed configurations, hotel blocks, elevators, meal service, and proximity are subject to supplier confirmation, local conditions, and availability. Hotel names displayed as “or similar” are planned accommodations, not unconditional guarantees. If substitution is required, we may provide a hotel of reasonably comparable standard, category, service level, and practical location, taking into account availability and local conditions. For Hajj, hotel and camp assignment is determined by Nusuk and the Saudi service provider (Section 9.4).
11.2 Walking-distance estimates are approximate and may change due to entrance access, road closures, crowd-control measures, weather, personal mobility, traffic, construction, or the route actually used. A Package requiring a shuttle or scheduled transport will be identified as such in the package details or final itinerary. Hotel star classifications are local supplier classifications and may differ from United States expectations.
11.3 Quad, triple, double, and single room pricing is based on the stated occupancy. Customers requesting shared occupancy authorize Hisar Tour to attempt to arrange same-gender roommates where possible. Roommate preferences are accommodated where possible but are not guaranteed. If appropriate roommates are not available, you may be required to pay the price difference for a different room category or accept an available alternative.
11.4 Itineraries, ziyārah, optional additional Umrahs, seminars, meal times, and group activities are subject to schedule, access, weather, health, crowd-control, safety, and operational conditions. Guided historical visits and optional additional group Umrahs are not guaranteed and may be changed, canceled, or replaced where reasonably necessary.
12.1 Hisar Tour may provide scholar-guided group support, educational sessions, group leaders, imams, murshids, and practical coordination. Guidance is offered to support the group journey and does not guarantee personal availability at all times, individualized religious rulings, or any particular spiritual outcome.
12.2 Participants with personal religious, health, or mobility questions should seek individual advice from a qualified professional or scholar. Participation in optional activities is subject to your health, the group schedule, Saudi regulations, and the instructions of the responsible group leader or scholar.
Umrah and Hajj involve substantial walking, dense crowds, high temperatures, extended standing, stairs, uneven surfaces, delays, and changes in schedule. You are responsible for assessing whether you are medically and physically able to travel and participate, and for obtaining medical clearance where appropriate. Please disclose mobility needs, wheelchair needs, dietary needs, or other relevant assistance requests before booking or as soon as they become known.
We will use reasonable efforts to communicate disclosed needs to relevant suppliers and to coordinate practical support where available. However, unless expressly agreed in writing, Hisar Tour does not provide personal nursing, medical care, continuous mobility assistance, personal attendants, or guaranteed accessible facilities. Medical decisions and emergency treatment are the responsibility of the traveler and the relevant medical providers.
You acknowledge that Umrah and Hajj carry inherent risks, including heat illness, dehydration, exhaustion, crowd pressure, falls, injury, communicable illness, and aggravation of pre-existing medical conditions. You voluntarily accept these inherent risks as a condition of participation.
You authorize Hisar Tour, its group leaders, and its representatives to arrange emergency medical assistance on your behalf if you are unable to do so, at your expense. You accept responsibility for the cost of any medical treatment, hospitalization, evacuation, or repatriation.
Saudi health insurance included with a Hajj or Umrah visa is not travel insurance. Where a package or Nusuk program states that insurance is “included,” this refers to the basic Saudi health coverage attached to the visa or program. It does not provide trip cancellation, trip interruption, emergency medical evacuation, repatriation, baggage, or comprehensive medical travel coverage.
Separate travel insurance is strongly recommended, including coverage for trip cancellation and interruption, emergency medical treatment and evacuation, baggage, and personal liability. Hisar Tour does not provide insurance advice and is not responsible for losses that could have been covered by travel insurance.
This Section does not apply to the Nusuk Hajj package price. See Section 9.5.
All cancellation requests must be made in writing. A cancellation becomes effective only when acknowledged in writing by Hisar Tour. Package-specific cancellation terms on your invoice or confirmation control where they differ from this Section.
Customized arrangements are subject to the cancellation, change, fare, and refund rules of each supplier. Most deposits, airline tickets, hotel blocks, visa-related charges, and customized services are non-refundable or carry change fees.
No refund is due for no-shows, late arrivals, early departures, voluntary itinerary changes, unused hotel nights, meals, transfers, tours, or activities, except to the limited extent a supplier actually returns funds to Hisar Tour for the unused service.
Any approved credit, transfer, name change, or rebooking is at Hisar Tour’s discretion and remains subject to supplier rules, availability, fare differences, deadlines, and administrative charges.
Where the law of your state of residence grants a cancellation, disclosure, or refund right that cannot be waived, that right applies and prevails over this Section to the extent of any conflict.
15.1 We may modify, substitute, re-route, reschedule, or cancel a Package when reasonably necessary because of airline changes, hotel availability, operational conditions, safety, crowd controls, government directives, weather, security conditions, public-health measures, supplier changes, force majeure, or other circumstances beyond our reasonable control.
15.2 Where we make a material pre-departure change within our reasonable control, we will offer you a reasonably comparable alternative, a credit, or a refund of amounts received by us less non-recoverable supplier costs, as permitted by applicable law.
15.3 Except as required by law, we are not responsible for incidental expenses, separately booked services, lost wages, visa costs, or consequential losses.
15.4 Changes to a Nusuk Hajj package are made by Nusuk or the Saudi service provider, not by Hisar Tour. See Section 9.
16.1 You are responsible for your luggage, passport, medication, money, electronics, valuables, and personal belongings at all times. Airline baggage policies, allowances, and fees apply. We recommend labeling all baggage, using hotel safes where available, carrying essential medication in hand luggage, and maintaining travel insurance.
16.2 Hisar Tour is not liable for loss, theft, damage, or delay of personal property, except to the extent caused directly by our own negligence and not otherwise excluded by applicable law.
17.1 All participants must behave respectfully toward fellow pilgrims, staff, suppliers, local residents, and authorities.
17.2 We may refuse a booking, remove a participant from an activity, or terminate participation without refund where a person is reasonably believed to be disruptive, abusive, threatening, intoxicated, violent, unsafe, non-compliant with lawful instructions, in breach of local law, or likely to endanger themselves or others.
17.3 In such cases, the participant is responsible for all additional lodging, transportation, return travel, fines, damages, and other costs. Hisar Tour may also decline or cancel a booking because of suspected fraud, sanctions or legal restrictions, material breach of these Terms, non-payment, or abusive communications.
18.1 Third-party suppliers. To the maximum extent permitted by law, Hisar Tour is not liable for the acts, omissions, negligence, delays, cancellations, service failures, injuries, illnesses, losses, or defaults of independent suppliers, including airlines, hotels, transport providers, camp operators, visa processors, local operators, the Nusuk platform, government authorities, or other third parties.
18.2 Excluded damages. To the maximum extent permitted by law, Hisar Tour will not be liable for indirect, incidental, special, punitive, or consequential damages; loss of enjoyment; emotional distress; missed opportunities; lost profits; or expenses arising from circumstances outside our reasonable control.
18.3 Liability cap. Except where liability cannot legally be limited, Hisar Tour’s total aggregate liability for any and all claims relating to a Package will not exceed the total amount actually paid by you to Hisar Tour for that Package.
18.4 Hajj cap. For Hajj, the amount “actually paid to Hisar Tour” means only the separately invoiced Hisar Tour service fee or separately arranged service amount under Section 3.3. It does not include the Nusuk package price, which is not paid to or received by Hisar Tour.
18.5 Force majeure. “Force Majeure” includes events beyond our reasonable control, such as war, terrorism, civil unrest, government action, border closures, visa restrictions, pandemics, outbreaks, quarantines, natural disasters, extreme weather, fire, labor disruptions, transportation interruptions, technical failures, power outages, communications failures, and supplier insolvency. In a Force Majeure event, we may alter, postpone, or cancel services and will reasonably assist with available supplier credits or recoveries, but we do not guarantee a refund or outcome that is not provided by the relevant supplier or required by law.
18.6 Savings clause. Nothing in these Terms limits, waives, or disclaims any right or remedy that cannot lawfully be limited, waived, or disclaimed under the law of the State of New Jersey or of any other jurisdiction whose law applies to you. No provision of these Terms shall be enforced against a consumer to the extent such enforcement is prohibited by the law applicable to that consumer.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Hisar Tour and its officers, employees, agents, and affiliates from claims, damages, fines, penalties, losses, and reasonable legal or collection costs arising from your breach of these Terms, your unlawful conduct, false or incomplete information you provide, damage you cause, your failure to comply with visa or travel rules, or claims by travelers you booked for and represented that you were authorized to bind.
We will give you prompt written notice of any claim for which we seek indemnification, allow you to control the defense with counsel reasonably acceptable to us, and cooperate reasonably at your expense. You may not settle any claim in a way that imposes a non-monetary obligation on Hisar Tour or admits fault on our behalf without our prior written consent.
20.1 Privacy Policy. We process personal information in accordance with our Privacy Policy. The Privacy Policy is a notice describing our information practices. It is provided to you for your review and is not itself a contractual term of this agreement.
20.2 Sharing. You authorize us to use and share your information with suppliers, government authorities, the Nusuk platform, and service providers as reasonably necessary to arrange travel, process documents, provide support, and comply with legal obligations.
20.3 Communications consent. By providing a telephone or mobile number, you consent to receive calls and messages from Hisar Tour by telephone, SMS, WhatsApp, and similar messaging services — including messages sent using automated technology — regarding your inquiry, registration, booking, payments, documents, operational updates, safety notices, and travel arrangements.
20.4 Marketing messages. Consent to receive marketing messages is not a condition of purchase and is collected separately. Message and data rates may apply. Message frequency varies. Reply STOP to opt out of promotional messages and HELP for assistance. Opting out of marketing does not stop essential transaction and travel communications, which we may continue to send while your booking is active.
Hisar Tour records photographs, video, and audio during group programs, seminars, ziyārah, and travel, for group documentation, education, and promotion. Where you appear incidentally as part of a group, you grant Hisar Tour a non-exclusive, royalty-free, worldwide license to reproduce and publish that material in any medium, without further compensation. Notice that recording is taking place will be given at the start of seminars and webinars and before planned group filming.
Where Hisar Tour wishes to publish material in which you are individually featured — including a named quotation, an individual testimonial, an interview, or footage in which you are the principal subject — we will obtain your separate written consent before publication. Giving or withholding that consent has no effect on your booking, your price, or the services you receive.
We will not publish material in which a traveler under 18 is individually featured without the written consent of a parent or legal guardian.
You may opt out of Section 21.1 recording at any time by notifying us in writing before departure, or by notifying your group leader at the time of recording. We will use reasonable efforts to exclude you from material published after your notice.
If you later ask us to remove material in which you appear, we will remove it from Hisar Tour’s own website and from the social media channels Hisar Tour controls within a reasonable time, and we will stop using it in future material. We cannot recall printed material already distributed, or content that third parties have independently downloaded, shared, or republished.
Testimonials, reviews, and video statements published by Hisar Tour reflect the individual experience of the person who provided them. They are not a guarantee that any other traveler will have the same experience or result.
22.1 If an issue arises during travel, you must notify the relevant Hisar Tour representative or local contact promptly, so that we have a reasonable opportunity to investigate and address it.
22.2 A written claim must be submitted to hisartour@uama.us within 30 days after your return date, and must include the booking reference, a clear description of the issue, and supporting documents where available.
22.3 Failure to notify us promptly may limit our ability to remedy the issue, but does not waive any right that cannot be waived under applicable law.
This Section affects your legal rights. It requires most disputes to be resolved by binding individual arbitration rather than in court, and it waives your right to a trial by jury and your right to participate in a class action. You may opt out within 30 days under Section 23.6.
23.1 Informal resolution first. Before starting arbitration or filing any claim, the parties agree to make a good-faith effort to resolve the dispute informally for at least 30 days after written notice describing the dispute and the relief sought. Notice to Hisar Tour should be sent to hisartour@uama.us and to 970 Clifton Avenue, Suite 202, Clifton, NJ 07013.
23.2 Agreement to arbitrate. If the dispute is not resolved informally, you and Hisar Tour agree that any dispute, claim, or controversy arising out of or relating to these Terms, a Package, the Services, or the relationship between us — whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory — will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and not in court. The arbitration will be seated in New Jersey, or conducted by telephone, videoconference, or on documents at your election.
23.3 What you are giving up. By agreeing to arbitration, you and Hisar Tour are each giving up the right to sue in court and the right to a trial by jury. An arbitrator, not a judge or jury, will decide the dispute. Discovery and appeal rights in arbitration are more limited than in court.
23.4 Class action waiver. You and Hisar Tour each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding.
23.5 Small claims exception. Either party may bring an individual claim in a small claims court of competent jurisdiction instead of arbitration, provided the claim remains in that court and on an individual basis.
23.6 Your right to opt out. You may opt out of this Section 23 by sending written notice to hisartour@uama.us with the subject line “Arbitration Opt-Out,” stating your full name, booking reference, and that you opt out, within 30 days of the date you first accept these Terms. Opting out will not affect your booking, your price, or any other part of your relationship with Hisar Tour. If you opt out, Section 24 governs your disputes.
23.7 Fees. Arbitration filing, administration, and arbitrator fees are governed by the AAA Consumer Arbitration Rules, which cap the amount a consumer pays. Hisar Tour will pay all filing, administration, and arbitrator fees in excess of the consumer’s capped portion under those Rules, except where the arbitrator determines a claim was filed for an improper purpose.
23.8 Severability of this Section. If the class action waiver in Section 23.4 is found unenforceable as to a particular claim or request for relief, then this entire Section 23 is void as to that claim or request for relief, and it must be brought in a court of competent jurisdiction under Section 24. All other claims remain subject to arbitration.
24.1 Governing law. These Terms and any dispute arising from them are governed by the laws of the State of New Jersey and applicable United States federal law, without regard to conflict-of-law principles, except where another law must apply. The arbitration agreement in Section 23 is governed by the Federal Arbitration Act.
24.2 Venue. For any dispute not subject to arbitration, the state and federal courts located in New Jersey have exclusive jurisdiction, and each party consents to that venue and jurisdiction. Nothing in this Section limits a consumer right that cannot be limited by law.
24.3 Time limit. Any claim arising out of or relating to these Terms, a Package, or the Services must be commenced within one (1) year after the claim accrued, or within such longer period as applicable law requires.
You consent to receive these Terms, invoices, booking confirmations, travel documents, and notices electronically. You agree that your electronic acceptance — by checking an acceptance box, submitting a registration or booking form, applying an electronic signature, or making a payment — has the same legal effect as a handwritten signature under the United States E-SIGN Act and applicable state law.
We record the date, time, and version of the Terms you accepted, and will provide you with a copy on request. You may withdraw consent to electronic records by writing to hisartour@uama.us, but we may then be unable to continue providing certain Services electronically.
Where Hisar Tour holds a seller of travel registration, industry accreditation, or similar authorization in a particular jurisdiction, the applicable registration details are disclosed in the booking documentation for that jurisdiction and on request.
27.1 Entire agreement. These Terms, together with the applicable booking confirmation, invoice, and package-specific terms, constitute the entire agreement between you and Hisar Tour regarding the Services, and supersede all prior discussions, representations, and understandings. The Privacy Policy is a notice provided to you and is not incorporated as a contractual term.
27.2 Severability. If any provision is held invalid or unenforceable, the remaining provisions remain effective, and the invalid provision will be enforced to the maximum extent permitted by law.
27.3 No waiver. Our failure to enforce a provision is not a waiver of that provision or any other right.
27.4 Changes to these Terms. We may update these Terms from time to time. The version accepted by you at the time of booking applies to that Package, unless a later change is required by law or by a government or platform rule. Material changes will be reflected in a new version number and effective date.
27.5 Assignment. You may not transfer your rights or obligations without our written consent. We may assign our rights or obligations in connection with a merger, reorganization, sale, or transfer of business assets.
27.6 Notices. Notices to Hisar Tour must be sent to hisartour@uama.us and to HISAR USA INC., 970 Clifton Avenue, Suite 202, Clifton, NJ 07013, USA. Formal legal process must be served on the Corporation’s registered agent at the registered office shown in the current records of the New Jersey Division of Revenue and Enterprise Services. Notices to you will be sent to the email address, postal address, or mobile number in your booking record.
27.7 Language. These Terms are issued in English. Any translation is provided for convenience only. In the event of inconsistency, the English version governs.
27.8 Survival. Sections 5.4, 7.4, 13.3, 16, 18, 19, 20, 21, 22, 23, 24, 25 and 27 survive completion of travel and termination of this agreement.
27.9 No third-party beneficiaries. These Terms do not create rights in any person other than you and Hisar Tour, except that Section 19 benefits Hisar Tour’s officers, employees, agents, and affiliates.
27.10 Headings. Headings are for convenience only and do not affect interpretation.
Travelers under the age of 18 must travel with a parent or legal guardian who is also booked on the same Package. Hisar Tour does not accept unaccompanied minors. The booking adult is responsible for the supervision, conduct, documents, and safety of any minor in their party, and accepts these Terms on the minor’s behalf.
